Atlanta ADU Zoning Laws: What You Need to Know
Atlanta has been steadily updating its zoning rules to encourage more ADUs as a way to address the city’s growing housing demand. But navigating these regulations can still feel like a maze if you’re not familiar with local codes.
Which Zones Allow ADUs?
In Atlanta, ADUs are generally permitted in several residential zoning districts. There are ten zones in Atlanta, and the good news is up to 83% of properties are zoned in R-4, R-4A, R-5! However, not all lots within these zones automatically qualify, there are specific requirements you need to meet.
A large portion of properties are also zoned R-1, R-2, or R-3, and while these properties do not allow for ADUs, they do have a caveat for allowing Guest Houses.
R-1 has the tightest restriction, with a minimum lot requirement of 2 acres. We won’t go into too much detail about guest houses here, but the main differences are:
- They can be no larger than 750 square feet or 30% of the main home’s size
- They can only have a wet bar, not a full kitchen with a stove.
Lot Size and Setbacks
Typically, your property needs to meet a minimum lot size, often around 5,000 square feet, though this can vary by neighborhood. The distance your ADU must be from property lines also applies – these are called setbacks. Usually, you’ll need to keep your ADU at least 5 feet away from side and rear property lines, but some areas have stricter rules.
Size and Height Limits
Atlanta limits the size of ADUs to ensure they remain secondary to the primary residence. Most ADUs can be up to 750 square feet with height restrictions generally keep ADUs under 20 feet tall, keeping them in scale with the neighborhood.
Parking and Owner-Occupancy
Parking is another important consideration. Atlanta does not require any type of specific parking. Other cities require at least one off-street parking space for the ADU.
There is no owner-occupancy requirement in Atlanta, meaning you don’t have to live on-site to build and rent out an ADU. But in Marietta and Alpharetta, an owner must occupy the main residential home or the ADU.
